In the 1971 Lok Sabha elections, a case was filed against then Prime Minister Indira Gandhi for allegedly violating the Model Code of Election Conduct. In June 1975, the Allahabad High Court convicted Indira in that case. Indira went to the Supreme Court and sought a stay on the High Court's verdict. Then he issued a state of emergency.

Indira Gandhi was accused of having a bigger platform than the size prescribed by the code of conduct during an election rally in Uttar Pradesh. The state government provided electricity and water in that public meeting. Both are wrong according to the standard code of conduct. Thirdly, Yashpal Kapur, an employee of the Prime Minister's Secretariat, was made Indira's election agent without resigning.
